AM Capital (“AM Capital”, “we”, “us”) provides business funding to Canadian businesses. This policy explains what personal and business information we collect, why we collect it, who we share it with, and what you can ask us to do with it. It applies to amcapital.ca and to our funding application process.

We handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

Who we are

Information we collect

Information you give us when you apply. When you submit a funding application, whether on this website or by email, we collect:

Your name and the legal and operating name of your business
Your email address and telephone number
Business bank statements, typically the three most recent months
Business details such as industry, time in business, revenue and address
Any other documents you choose to send us in support of an application, which may include a void cheque, identification, tax or lease documents

Information we collect automatically. When you visit this website we collect standard technical information through cookies and analytics tools, including IP address, browser type, device type, pages viewed, time on page, and the site or advertisement that referred you. Where you arrive from an online advertisement we may record an identifier that lets us measure which advertisements lead to applications.

Information from third parties. With your consent, and where relevant to assessing an application, we may obtain information from credit reporting agencies, business registries, and public sources.

Why we collect it

To assess your funding application and verify the information in it
To obtain funding offers for your business, which may involve sharing your file with funding partners as described below
To contact you about your application, an offer, or an existing funding agreement
To administer and service any funding you accept
To meet legal, regulatory, anti-money-laundering and record-keeping obligations
To operate, secure and improve our website, and to measure the effectiveness of our advertising

We do not sell your personal information, and we do not sell or rent your contact details to lead brokers, list vendors or advertisers.

Sharing with funding partners

This is the most important disclosure in this policy, so we state it plainly. Depending on your file, AM Capital may fund your business directly, or may place your application with one or more third-party funding partners in order to obtain an offer for you.

Where we place your application, we share the information you provided, including your business bank statements, with those funding partners so they can underwrite the file. By submitting an application you consent to this sharing for the purpose of obtaining funding offers. Each funding partner handles your information under its own privacy policy and is responsible for its own use of it.

If you would prefer that we not share your file with any third-party funding partner, tell us before or at the time you apply and we will limit our review to funding we can provide directly. Withdrawing that consent may mean we cannot obtain an offer for you.

Service providers

We use third-party services to run our business. These providers process information on our behalf and only for the purposes we specify. They currently include our online form provider (Jotform), our customer relationship management system (Close), our website host, our email provider, and website analytics and advertising measurement services (including Google Analytics and Google Ads).

Some of these providers store or process information on servers located outside Canada, including in the United States. Information held in another country may be accessible to the courts, law enforcement and national security authorities of that country under its laws.

Cookies and advertising

This website uses cookies. Strictly necessary cookies keep the site working. Analytics and advertising cookies help us understand how the site is used and which advertisements lead to applications. You can manage your choices through the cookie banner on this site, and you can block or delete cookies in your browser settings, though parts of the site may not work as intended if you do.

How we protect your information

Bank statements and application files are sensitive, and we treat them that way. We use access controls, encrypted transmission and reputable service providers to protect the information we hold. Access within AM Capital is limited to people who need it to assess or service your file. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

How long we keep it

We keep application information for as long as it is needed for the purposes described in this policy and for as long as we are required to keep it by law. Where a funding agreement is entered into, financial and transaction records are generally retained for at least seven years to meet tax and regulatory record-keeping requirements. Where an application does not proceed, we retain the file for a shorter period so that we can respond to questions and reconsider the file if circumstances change, and you can ask us to delete it sooner.

Your rights

Under Canadian privacy law you can:

Ask what personal information we hold about you and request access to it
Ask us to correct information that is inaccurate or incomplete
Withdraw your consent to our use or sharing of your information, subject to legal and contractual restrictions and to reasonable notice
Ask us to delete information we are not required to keep
Ask how your information has been used and who it has been disclosed to

To make any of these requests, email alex@amcapital.ca. We will respond within thirty days. We may need to verify your identity before acting on a request.

If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca or 1-800-282-1376.

Marketing communications

If we send you commercial electronic messages we do so in accordance with Canada’s Anti-Spam Legislation. Every such message includes an unsubscribe link, and you can also unsubscribe by replying to any message or emailing alex@amcapital.ca. Messages about an application you submitted or funding you hold are not marketing and will continue regardless.

This site may link to websites we do not operate. We are not responsible for their content or their privacy practices, and we encourage you to read their policies.

Children

This website and our services are directed at businesses and business owners. We do not knowingly collect personal information from anyone under the age of majority.

Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last revised. Material changes affecting how we use information you already gave us will be communicated to you directly where practical.
